The BienEtrePrestige.fr website (hereinafter “the Site”) is published by the Seller above.
2. Scope of application
These General Terms and Conditions govern the sales of products and digital content offered on the Site to consumers within the meaning of the Consumer Code (B2C). For purchases by professionals , see Article 17 (specific B2B provisions).
3. Products and availability
The essential characteristics (dimensions, materials, power, compatibilities, instructions) are described on each sheet. The photos are for illustrative purposes only. Offers are valid as long as they are visible, within the limits of stocks or availability at our partners/suppliers ( dropshipping possible). In the event of unavailability after ordering, we will inform you and proceed with a full refund or an alternative proposal .
4. Price
Prices are indicated in euros , [[incl. VAT / excl. VAT if B2B]] excluding delivery costs. Delivery costs, possible installation, taxes or applicable eco-participations are indicated before final validation. The Seller may modify prices at any time, but the products are invoiced on the basis in force at the time of the order.
5. Order
The customer selects the products, enters their contact details, chooses the delivery and payment method, and then confirms . Before payment, a summary allows you to check the details. The email confirmation constitutes proof of contract . The Seller reserves the right to refuse a legitimate order (fraud, previous dispute, abnormal quantities).
6. Payment
Accepted methods: credit card , PayPal , bank transfer , [[payment in 3x/4x]] via service provider. The debit is made when ordering. In the event of split payment, the service provider's conditions apply.
Retention of title clause: The goods remain the property of the Seller until full payment of the price.
7. Delivery
7.1 Zones, time limits & modes
Delivery in mainland France [[+ other areas]]. For bulky products (4D chairs, sauna cabins, balneotherapy, cold plunge, etc.), delivery by carrier by appointment at the bottom of the building / doorstep [[or “with installation in the room” if offered]]. Indicative delivery times are provided on the product sheets and in the basket.
7.2 Receipt & transport damage
Upon delivery, check the condition of the package and the product in the presence of the delivery person . In the event of damage or missing items: make specific and detailed reservations on the delivery slip (e.g. "shock on the right side, scratched tank"), then notify us within 48 hours at [[ sav@bienetreprestige.fr ]] with photos. Without specific reservations, transport remedies are compromised.
7.3 Transfer of risks
The risks of loss or damage are transferred to the customer when he takes physical possession of the goods.
8. Right of withdrawal (B2C)
You have 14 days from receipt to withdraw, without giving a reason.
8.1 Legal Exclusions
No withdrawal for:

personalized goods or made to your specifications,

digital content not provided on physical media after your express consent to start before the end of the period and waiver of withdrawal,

sealed goods cannot be returned for hygiene reasons if opened after delivery.
8.2 Return procedures
Before any return, contact [[ sav@bienetreprestige.fr ]] to obtain agreement and instructions (return address, pallet transport appointment, original packaging, etc.).

You return the goods within 14 days of notification.

The products must be new , complete, clean, with original packaging and accessories .

Removal/uninstallation required for fixed/installed products (balneotherapy, cabins).

Digital content already downloaded/activated with waiver is non-refundable.
8.3 Return costs (bulky)
In accordance with the Consumer Code, direct return costs are the responsibility of the customer if we have indicated them in advance. For information (pallet returns in mainland France):

The exact cost depends on weight/volume, location, and services (floor pickup, etc.). We can offer a shipping label at the negotiated rate.
8.4 Reimbursement
We will refund all amounts received (excluding additional services selected: installation, delivery of living space, etc.), including the initial standard delivery, within 14 days of your withdrawal or proof of return shipment. Possible discount in the event of depreciation resulting from excessive handling.
9. Legal guarantees (B2C)
9.1 Legal guarantee of conformity
You benefit from the legal guarantee of conformity for goods (2 years from delivery). In the event of a lack of conformity, you are entitled to compliance without charge (repair or replacement). If this is impossible or disproportionate, you can obtain a price reduction or the cancellation of the sale.
9.2 Warranty against hidden defects
Regardless of conformity, you benefit from the guarantee against hidden defects (art. 1641 et seq. C. civ.). You can return the goods and have the price refunded, or keep them and have part of the price refunded.
9.3 Implementation
Contact [[ sav@bienetreprestige.fr ]] with proof of purchase, description of the defect, photos/videos. We organize diagnosis, parts and intervention as appropriate. No advance costs can be requested from you under the applicable legal warranty.
10. Commercial guarantee (if applicable)
Some products come with a manufacturer's warranty (e.g., 2–5 years for motors/electronics). The terms and conditions are listed in the instructions or on the product sheet. This warranty is in addition to, and does not replace , legal warranties .
11. After-sales service & spare parts
We provide after-sales service in France : email/phone support, and spare parts (motors, electronic boards, pumps, covers, remote controls) for [[24 months or more]] when available. Delivery times and costs are communicated on a case-by-case basis.
12. Digital content / online services
For guides, programs, audios or any digital content:

By choosing delivery before the end of the withdrawal period, you consent to immediate execution and waive your right of withdrawal for this content (checkbox at checkout).

Personal and non-transferable licenses. Any unauthorized reproduction/sharing is prohibited.

14. Liability
The Seller is not liable for indirect damages (loss of business, data, etc.) or for improper assembly/installation that does not comply with the instructions, or for unintended uses (e.g., unprotected outdoor sauna, unsuitable power supply). For bulky products, the buyer must ensure accessibility (doors, stairs, elevators, power supply, drains) before delivery .
15. Force majeure
No party shall be liable in the event of failure due to a force majeure event within the meaning of the law and case law (natural disasters, strikes, network failures, administrative decisions, etc.).
16. Personal data
Data is processed in accordance with our Privacy Policy [[link]], including for order processing, fraud prevention, and after-sales service. You have GDPR rights (access, rectification, deletion, opposition, portability).
17. Specific provisions for Professional Customers (B2B)
For customers purchasing as part of their business :

No legal right of withdrawal.

Transfer of risks upon shipment if agreed EXW/FCA (Incoterms); otherwise upon receipt.

Liability limited to the amount excluding tax of the order, except in cases of gross negligence/wilful misconduct.

18. Intellectual Property
All texts, visuals, logos, and videos on the Site are protected. Any reproduction without authorization is prohibited.
19. Applicable law – Competent jurisdiction
These General Terms and Conditions are subject to French law . For B2C disputes, the French courts have jurisdiction in accordance with the rules of common law; the consumer buyer may refer the matter to the court of their place of residence.
